United Airlines Molestation Lawsuit - Update

Commentator Lyndsay Markley offers an update to her earlier commentary on an LBN report on a child molestation lawsuit against United Airlines. United has filed a motion to dismiss the case. Lyndsay Markley, who represents the plaintiffs, has responded to the motion.

United Airlines wants the state lawsuit dismissed for failure to state a cause of action. In general, under Illinois law, there is no liability for the criminal acts of third parties. United is claiming third-party status. Markley’s response is that Illinois case law supports the notion that United is liable.

United has also maintained that it was not actively involved in the mentoring program that gave rise to the complaints. Markley challenges this proposition. She says that the airline and Gerald Greenwald, the former chairman and CEO of United Airlines. She says that most of her clients knew Greenwald and his wife. There were two videos showing United’s participation in the program. As of this date, fourteen claimants have come forward.

Markley believes that the trial court will rule in her favor on the motion and that discovery will commence.
